Eligibility

Eligibility to use Lumospad is subject to the following conditions:

1. If you are an individual, you must be at least 18 years old, or of legal age in your jurisdiction, to create an account and use our services.
2. You are not in, or under the control or resident or national of, any country or jurisdiction that is prohibited by law or regulation from using our services. For example, Afghanistan, Cuba, Iran, and North Korea are currently prohibited countries. Additionally, if you are a person on economic sanctions, you are prohibited from using our services.
3. We reserve the right to cancel or suspend your account or any transactions with or without notice if you or your jurisdiction of residence or citizenship becomes prohibited, or if we determine that you do not meet the eligibility requirements outlined in this paragraph.

Definitions

"Account" means the Lumospad user account that you create when you register with Lumospad.

"Agreement" means these Terms and Conditions, and all other documents incorporated herein by reference.

"Lumospad" refers to the Lumospad website, mobile application, and related services.

"Lumospad Operator" refers to Aspexi Krzysztof Dryja, a company registered in Poland with tax identification number PL8141593383.

"Services" means all services provided by Lumospad, including but not limited to the Lumospad platform, digital wallet, and all other services offered by Lumospad.

"User" refers to any individual or entity that accesses or uses the Lumospad platform, including but not limited to registered users, visitors, and any person or entity that views, accesses, or uses the Lumospad platform in any manner.

"Blockchain" refers to a distributed ledger technology used by Lumospad for recording and verifying transactions on the Lumospad platform.

"Token" refers to any digital asset that is supported by the Lumospad platform, including but not limited to cryptocurrencies, tokens, and other digital assets.

Account

To use certain features of Lumospad, you must register and create an account. You may create an account by linking your Lumospad account with your MetaMask wallet or by choosing a username and password. You are solely responsible for maintaining the confidentiality of your username, password, and other account information, and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to comply with this section.

Services

Lumospad provides a range of services including Mempool for Traders, Contract Checker, New Tokens Database, and Signals. Please be advised that while we strive to provide the most accurate and up-to-date information possible, Lumospad is not responsible for any loss or damage that may arise from the use of our services. We do not provide investment or financial advice, and all trades and investments made by users are done so at their own risk.

Furthermore, please note that the blockchain ecosystem is complex and rapidly evolving. As such, the data provided by Lumospad may be subject to error or delay. While we make every effort to ensure the accuracy of our data, we cannot guarantee that it is always up-to-date or error-free.

By using Lumospad services, you agree to assume full responsibility for any actions taken based on the information provided. We strongly recommend that users conduct their own research and consult with a financial or investment professional before making any investment decisions.

Mempool for Traders

Mempool for Traders is a service that provides traders with real-time data on pending transactions waiting to be added to the blockchain. Please note that the transactions displayed to you are mempool transactions, meaning that not all of them will necessarily be added to the block or validated. Additionally, while we do our best to parse the transactions data correctly, it may sometimes show incorrect data or be misleading. Therefore, you should use the data provided by Mempool for Traders with caution and do your own due diligence before making any decisions based on the information provided.

The mempool data is fetched from public blockchain infrastructure, which may, in some cases, not be up to date. As a user of Lumospad's Mempool for Traders service, you must be aware that the data provided is subject to change, and you should always confirm any information with a reliable source. By using our Mempool for Traders service, you acknowledge and agree that Lumospad is not responsible for any losses, damages, or other negative consequences resulting from the use of our service.

Contract Checker

The Contract Checker service provided by Lumospad allows users to access data related to smart contracts, including but not limited to token taxes and trading status. While Lumospad makes every effort to accurately parse token controlling transactions, the constant changes to the smart contract data may mean that the information displayed is not always accurate and could be misleading. Similarly, while Lumospad provides smart contract source code analysis, this may also be inaccurate, particularly in cases where the contract is a proxy contract and the source code is not available or is hidden. Please note that Lumospad is not responsible for any loss or damage that may arise from your use of the Contract Checker service.

New Tokens Database

The New Tokens Database is a service provided by Lumospad that displays newly created tokens with their name and contract address. The information is read in real-time, so users can stay up-to-date with the latest token creations. Please note that Lumospad is not responsible for the accuracy or completeness of the information provided, as the data is obtained from publicly available sources.

Signals

Our Signals service focuses on new tokens that are launching soon or have recently launched, providing traders with information on potential opportunities and risks. We analyze blockchain data, bots, and transactions to provide insights into the latest market trends and emerging projects. Please note that our Signals service is provided for informational purposes only and Lumospad is not responsible for any losses or damages resulting from the use of this service.

Fees

Lumospad may charge fees for the use of any of its services, including but not limited to the Mempool for Traders, Contract Checker, New Tokens Database, and Signals. The fee schedule for specific services will be available for viewing on the Lumospad website and mobile application. Lumospad reserves the right to modify or update the fee schedule at any time with or without prior notice to its users. It is the responsibility of the user to regularly review the fee schedule to ensure compliance with any applicable fees.

Licenses; Intellectual Property

Lumospad and its licensors retain all right, title, and interest in and to the Site, the App, and the Services, including without limitation, all software, code, proprietary methods and systems, user interface designs, databases, technology, and any content displayed on the Site or the App. All rights are reserved.

Lumospad grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Site, the App, and the Services for personal, non-commercial use only, subject to these Terms and Conditions.

You agree not to reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site or App, except as follows:
Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials. You may store files that are automatically cached by your Web browser for display enhancement purposes. You may print or download one copy of a reasonable number of pages of the Site or the App for your own personal, non-commercial use and not for further reproduction, publication, or distribution. If we provide desktop, mobile, or other applications for download, you may download a single copy to your computer or mobile device solely for your own personal, non-commercial use, provided you agree to be bound by our end user license agreement for such applications.

Lumospad does not endorse, guarantee, or assume responsibility for any content, product, or service advertised or offered by a third party through the Site or the App, and Lumospad will not be a party to or in any way be responsible for monitoring any transaction between you and third-party providers of products or services. You are solely responsible for all of your communications and interactions with other users of the Site or the App and with other persons with whom you communicate or interact as a result of your use of the Services.

Restricted activities

You agree not to use the Services for any illegal, fraudulent, or unauthorized purpose, including, but not limited to, money laundering, terrorist financing, fraud, or any other type of financial crime or illegal activity. You further agree not to engage in any activities that violate the rights of Lumospad or any third party, including, but not limited to, infringing on any intellectual property or proprietary rights, publishing or distributing illegal or inappropriate content, or engaging in activities that could harm or disrupt the Services or Lumospad's business operations. Lumospad reserves the right to investigate and take legal action against any such activities, and to cooperate with law enforcement authorities and regulatory bodies in such matters.

User’s Representations and Warranties

By using Lumospad, you represent and warrant that:

1. You have read and understood these Terms of Service and will comply with them;
2. You are of legal age and have the legal capacity to enter into this agreement and to perform your obligations under these Terms of Service;
3. You will only use the Services for lawful purposes and in accordance with applicable laws and regulations;
4. You will not use the Services for any illegal, fraudulent, or unauthorized purpose;
5. You will not interfere with, disrupt, or attempt to gain unauthorized access to any servers or networks connected to the Services;
6. You will not use the Services to distribute, disseminate, or transmit any harmful, harassing, defamatory, or otherwise objectionable content;
7. You will provide accurate and complete information in connection with your use of the Services; and
8. You will comply with all applicable laws and regulations regarding the use of the Services, including but not limited to those related to anti-money laundering and counter-terrorist financing.

Indemnification and Limitation of Liability

You agree to indemnify, defend and hold Lumospad and its affiliates, and their directors, officers, employees, agents, partners and licensors harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your use of the Services, your violation of these Terms, or your violation of any rights of another.

In no event shall Lumospad or its affiliates, or their directors, officers, employees, agents, partners and licensors be liable for any direct, indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party on the Services; (iii) any content obtained from the Services; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you. In such jurisdictions, the liability of Lumospad and its affiliates, and their directors, officers, employees, agents, partners and licensors shall be limited to the maximum extent permitted by law.

Disclaimer of Warranty and Release

YOU EXPRESSLY AGREE THAT USE OF THE SERVICES IS AT YOUR SOLE RISK. THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE MAKE NO WARRANTY THAT THE SERVICES WILL MEET YOUR REQUIREMENTS, OR THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE; NOR DO WE MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICES, OR AS TO THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE SERVICES, OR THAT DEFECTS IN THE SERVICES WILL BE CORRECTED.

YOU AGREE TO RELEASE, INDEMNIFY, AND HOLD US AND OUR AFFILIATES, SUBSIDIARIES, AND LICENSORS, AND EACH OF THEIR RESPECTIVE OFFICERS, DIRECTORS, AGENTS, AND EMPLOYEES, HARMLESS FROM ANY CLAIM OR DEMAND, INCLUDING REASONABLE ATTORNEYS' FEES, MADE BY ANY THIRD PARTY DUE TO OR ARISING OUT OF YOUR USE OF THE SERVICES, YOUR VIOLATION OF THESE TERMS, OR YOUR VIOLATION OF ANY RIGHTS OF ANOTHER.

Dispute Resolution and Applicable Law

In the event of any dispute arising out of or in connection with these Terms and Conditions or the use of Lumospad services, the parties shall first attempt to resolve such dispute through negotiation in good faith. If the parties are unable to resolve the dispute through negotiation, any legal action or proceeding arising under these Terms and Conditions or the use of Lumospad services shall be brought exclusively in the courts located in the jurisdiction where Lumospad is registered.

These Terms and Conditions shall be governed by and construed in accordance with the laws of the jurisdiction where Lumospad is registered, without giving effect to any principles of conflicts of law.

Risk Reminder

Lumospad is not responsible for any loss or damage caused by the use of our Services. The user acknowledges that using cryptocurrencies and blockchain technology involves inherent risks, such as high price volatility, network congestion, hacking, and human error. The user is solely responsible for managing their account, passwords, private keys, and personal information. Lumospad is not liable for any errors or omissions in the content of the Services or for any loss or damage of any kind incurred as a result of the use of any content, product, or service. The user should be aware that there is no legal entity that controls cryptocurrencies and that they are not backed by any government or financial institution. By using the Services, the user releases Lumospad from all liability and agrees to indemnify and hold Lumospad and its affiliates harmless from any claim, demand, or damage, including reasonable attorneys' fees, arising out of or related to the user's use of the Services.

Amendment

We may amend this agreement at any time by posting a revised version on the Site or the App. The revised version will be effective at the time we post it. If we make material changes, we will provide you with notice as required by law. Your continued use of the Services after the date any such changes become effective constitutes your acceptance of the new agreement.

Termination

Either party may terminate this agreement at any time for any reason by providing notice to the other party. Upon termination, you must cease all use of the Services and any outstanding transactions will be completed. Any provisions of this agreement that, by their nature, should survive termination of this agreement will survive termination, including but not limited to, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
